1.Booking Confirmation
A. All bookings are made with PERFECT GAP, which is a trading name of PERFECT GAP.
B. This booking will become the binding contract (“the Contract”) between the parties only when PERFECT GAP acknowledges receipt of the booking form & a non-refundable registration fee as in indicated clause 2a below.
C . The contract will be subject to these Booking Conditions (“the Conditions”) & will be governed & constructed in accordance with English law.

2.Payment Schedules
A. A non-refundable registration fee of 250 must be made with each booking. Confirmation of your booking will then be sent by return of post outlining the payment schedules.
B. The payment for the first invoice for 1745 must be received no later than 1st October 2007. The final invoice for the outstanding balance must be received no later than 1st November 2007.
C. All payments are non-refundable. PERFECT GAP will advise on travel insurance details at the time o the first invoice. Details of PERFECT GAP policy for students will be sent to you at this time.
D. Places on the PERFECT GAP training programme are on a first-come-first-served basis providing each payment is received on time.

3.Prices
A. PERFECT GAP reserves the right to impose surcharges in respect of cost increases relating to fuel, currency, UK,SWISS,FRENCH & CANADIAN government action.
B. PERFECT GAP will absorb an increase equivalent to 2% of the programme price, if the surcharge exceeds 10% of the programme price, you have the right to cancel and receive a full refund of invoices paid less any amendment or insurance premiums paid.
C. No refunds will be given if currency rates change.
D. The programme price includes all taxes to be paid.

4.CANCELLATION OF THE PROGRAMME BY PEFECT GAP
A. PERFECT GAP reserves the right to cancel any training programme. In the highly unlikely event of a training programme being cancelled, you will be offered the choice of an alternative arrangement or a full refund of invoices will be paid. PERFECT GAP will ensure any alternative arrangements offered are at least equivalent to those originally booked.
B. No refund will be payable if PERFECT GAP is forced to cancel the programme due to circumstances beyond our reasonable control and which could have not been foreseen or avoided even if due care had been exercised, including but not limited to war, riot, civil unrest or insurrection, strike lockout or other industrial action, act of terrorism, act of god, flood, avalanche or any other adverse weather conditions.

5.CANCELLATION BY YOU
A. If you wish to cancel a place on our programme or leave prematurely, all deposits & invoices are non-refundable. All insurance policies provided for this course should cover in part for such circumstances.

6.INSURANCE
A. Travel insurance is compulsory for all persons booking onto the PERFECT GAP programmes.
B. No discount on the programme fee will be provided if you wish to use your own insurance.
C. Please ensure that you make it clear to us, if you wish to rely on your own insurance cover.
C. Details of full cover must be provided to us & must be clearly show that the premium has been paid in full & is current.
D. Any alternative cover other than that provided by PERFECT GAP must be no less favorable than any travel insurance policy we offer.

6.LIMITATIONS OF LIABILTY
A. Whilst we (PERFECT GAP) take all reasonable precautions to prevent accidents or injury, you acknowledge & agree that some of the training you participate in our programme may carry a risk & injury.
B. We accept responsibility for death or bodily injury caused by or negligence or that of our employees, agents contractors or suppliers when acting in the course of their employment or in accordance with out instructions.
C. Except as provided in clauses C & D below, we accept responsibility for any loss or damage you suffer where any failure to perform, or improper performance, is not due to our negligence or that of our employees, agents or contractors or suppliers including but not limited to where any such failure or improper performance is attributable, in whole or part, to:
D.1you or any member of you party
D.2any third party unconnected with the provision of the services we have agreed to provide to you, & is not reasonably foreseeable or unavoidable: or
D.3any circumstances beyond our reasonable control not be foreseen or avoided even if due care had been exercised, including but not limited to war or threat of war, riot, civil unrest or insurrection, strike lockout or other industrial action, act of terrorism, act of god, flood, avalanche or any other adverse weather conditions.
E. Subject only to the limitation of liability in clause E below, our liability to you for any loss of damage which you may suffer, whether as a result of failure to perform, or the improper performance of, the services we have agreed to provide to you or otherwise is limited to 5,000,000 for any claims arising from a single event.]
F. Our limitation to you for the non-performance or improper performance by any air, sea or rail carrier or any hotel, chalet company or accommodation agent for any services to be provided by them as part of the programme is limited to the amount you can validly recover against such carrier, hotelier, chalet company or accommodation agent:
G. In accordance with any applicable domestic law or laws of UK,SWISS, FRANCE & CANADA, for claims other than death or bodily injury arising out of travel, carriage or accommodation.
G.1In accordance with international convention (if any) governing such service, for all claims arising out of any other travel, carriage or accommodation.
H. Except as expressly stated above we do not accept liability for any claim, whether arising in contract, tort (including negligence) otherwise for any consequential, indirect or special loss or damage however arising.
I. Nothing in these booking conditions affects your statuary rights.
J. Where your loss is due to the acts of our agents, suppliers or contractors, our acceptance of liability is subject to you assigning to us any rights you may have against them & to your co-operation with us in any legal action we take against them.
K. PERFECT GAP accepts the responsibility to provide you with a training programme as described in our brochure. If it fails to comply in whole or part, with any such description, we will pay you appropriate compensation (compensation payable will depend on the nature and extent of misdescription).
L. The availability of facilities advertised cannot be guaranteed as they may depend on local weather conditions or may close due to circumstances beyond our control, including but not limited to public holidays or routine maintenance. In such circumstances we cannot give refunds, but if we are aware of any facilities not available prior to departure we will advise accordingly.
M. We cannot except responsibility for any delay, however caused, in your outward or return journeys. We will give no refunds or compensation in relation thereto.

8.COMPLAINTS
A. While we make every effort to insure there is no cause for a complaint during the PERFECT GAP programme it is essential that we are informed as soon as possible, whereupon we will investigate any complaint and try and resolve it. If the matter cannot be resolved satisfactorily during the course please write to us within 28 days of your return home.
B. PERFECT GAP will only deal with the correspondence from the person on the programme

9. MEDICAL CONDITIONS
A. It is a condition of any PERFECT GAP programme that you inform us of any pre-existing medical conditions.

10. STUDENT BEHAVIOUR
A. PERFECT GAP students are not allowed to use or be in possession of any unlawful properties or substances. Should any such properties or substances be found on any student or in their belongings, PERFECT GAP have the right to immediately exclude them from the programme and are not responsible for their repatriation and all costs there of.
B. PERFECT GAP has the right to refuse to allow any person to participate in any activity, prior to, or during to any programme, if in PERFECT GAP’S opinion, the student is not compatible with the general enjoyment or wellbeing of others.
C. PERFECT GAP reserves the right to exclude any student who is acting in manner that is deemed to be dangerous, inappropriate or damaging to the reputation of the company.
D. PERFECT GAP reserves the right to exclude any student who is intoxicated.
E. PERFECT GAP has a no smoking policy whist in uniform between 0830 and 1700 daily.

11. USE OF MATERIALS AND INFORMATION
A. PERFECT GAP reserves the right to use ay photograph, film or creative materials taken at any time during the programme, for use exclusively in PERFECT GAP advertising or marketing material, with our obtaining further consent from any student.
B. PERFECT GAP reserves the right to release information regarding students to other organizations involved in the programme.
